Fairfax County Considers Easing Food Truck Restrictions

Fairfax County's Board of Supervisors will soon consider zoning changes that would make it significantly easier for food trucks to conduct business in the area.

Fairfax County could soon adopt new zoning rules that will make it significantly easier for food trucks to conduct business by allow them to visit construction sites, office buildings and shopping centers.

Food trucks are currently zoned as freestanding fast-food restaurants, which means they are required to obtain a special exemption from the Board of Supervisors costing more than $16,000. The proposed rule would allow food trucks to operate for as little as $175, including a $100 permit, permission from property owners, a $35 Solicitor’s License and a $40 Food Establishment Permit.

The proposed zoning rules only apply to private property, as food trucks will still be prohibited from parking on public roads to sell food. Trucks will be permitted to stay at any single location for up to four hours but may sell food from multiple locations. Up to three trucks will be allowed to operate at a single location.

Fairfax County issued zoning approvals to 14 food trucks last year. Food trucks will also be allowed on county property or Fairfax County Park Authority land, where there are 10 existing locations for licensed food trucks.

A planning commission public hearing is scheduled for Wednesday, July 30 followed by the board of supervisors’ public hearing Sept. 9.
